i have talked to a number of cv reps and a lawyer about the doctor call list manipulation for ic, the attorney says looks like a good candidate for a class action. Any thoughts?
I think it's a great class action suite because there is so much cheating and manipulation going on that those that are not cheating lose out in IC, promotions, decreased raise each year and the list goes on. Most companies have a static list of let's say 200 providers in every territory and allow for a TBM to add or delete up to 10% total. Every TBM then has the same # of providers and the same 10% to delete a provider if they are no see. Problem here is that some territories have 600 targets and some have 180. Some TBMs take out targets that write competitive business by saying that they have moved to another territory (one where the doctor had a previous address such as where they went t med school or did their residency) and others find big writers in adjacent territories and districts and add them to their targets even through they don't go there. It's disgusting that this is allowed to continue for so many years.
I spoke to an employment attorney about a bunch of things going on at our wonderful company and she laughed when I told her that I signed an arbitration agreement. When it comes to all of the major ways that you sue your employer such as age discrimination, anti-retaliation, as well as violations of the disability act or anything that has federal in front of it, there is no way BMS can keep any of us out of the state or federal court system including class action.....that whole thing was nothing but an intimidation dog and pony show that holds for maybe little trivial disputes at best.
